There being no Public comment the Chairman entertained motion. MOTION: Dennis Bal arini made a Motion to continue the -Public Hearing in this matter to March 16, 2005 at 7: 30 P.M. ; which Motion was duly seconded by Steve Dolan and so voted unanimou-s-ly.. Public Hearing Paul Thomas hrist-opher Costa Miller Farm Subdivision - off Bog River Bend Approval of Modification to Definitive Plan The appointed hour -having arrived the Chairman called the Public Hearing to order. The Town Planner reminded the Board this is a request for reduction and waiver from the subdivision regulations regarding the width of the pavement . Town Counsel has advised the proper way to achieve this request is by conducting a public hearing/definitive modifica-tion process . The Chairman recognized Doug Sneider, Costa Associates, who explained Applicant is seeking approval of modification of the. subdivision to allow pavement to remain as it exists ( o-ft. o .pavement) , as well as waiver of the review fee. The Chairman read the following letter into the Record, dated January 11, 2005, from Christopher Costa "Pursuant to our discussion with the Planning Board on January 5, 2005, I requested a heating be held to determine if the Mashpee Planning Board will modify the subdivision approval and grant a waiver from its regulations -under Section DTI I .E. -and section I I . E. b, which requires a twenty foot (2 o' ) wide travel way. The. ravel way i constructed at eighteen feet (1 ' .) wide, plus a one foot W wide berm on each side. Sheet 3 of the original subdivision plan has been revised and submitted for approval of this modification. l also request the Planning Board waive the $330 . 00 review fee as this is a modification.
