MOTION: Dennis l alzarini made a Motion to approve the Special Permit <br /> Application for Building Mounted Wind Turbines in this matter subject to Mr. owley's <br /> letter dated June 4, 2008 and FAA approval; which Motion was duly seconded by <br /> Thomas O'Hara and so voted unanimously. <br /> Discussion <br /> Zoning Articles for October Town Meeting—2008 <br /> Amendment to the Zoning Bylaw Subsection 174-25.1.9 of the Table of Use <br /> Regulations-Eplanation—A Special Permit from the Zoning Board ofappeals is now <br /> required for every pier, wharf, dock or boardwalk constructed in Mashpee, with a length <br /> limit of 70-f t. the length limit has frequently been varied by the Board clue to conditions- <br /> at the site, including marshes and depth of water. Permitting is also required from the <br /> Conservation Commission under the Mate and town wetlands lavers, by the state under <br /> Chapter 90 and sometimes by the Army Corps of engineers. This article would eliminate <br /> the requirement for a.special Permit and variance for most docks, and require a Special <br /> Permit only for docks which are proposed to cross-more than o-ft. of certain wetland, a <br /> defined in the State wetlands Laws and Regulations. Other docks would be allowed as <br /> of-right,under zoning, but still require Conservation Commission and other local, state <br /> and federal approvals. <br /> Amendment to the Zoning Bylaw Section 1 - .1, Subsection -Explanation— <br /> This article would allow motels, hotels,hospitals, infirmaries, nursing homes, <br /> convalescent homes, congregate care or assisted living facilities and similar uses <br /> authorized by Flnnin'g Board Special Permit in all Commercial zoning districts under the <br /> provisions of Section 174-45 to be increased to -stories and -ft. in height and to <br /> exceed 20,000 sq. ft. of first floor area if approved by the Board. Development of such <br /> facilities to current standards without these provisions is impractical. <br /> The Board-approved both of the proposed Articles as written. <br /> Public Hearing <br /> Scott Bauer—8 Blue Castle Drive <br /> Approval of Definitive Subdivision Plan -Lots <br /> Extension Agreement for 0-Days <br /> The appointed hour having arrived the Chairman read the Public Hearing notice <br /> into the record and called the Nblic Hearing to order. <br /> MOTION:.
