Mr. Niedwi cki explained that l lashpee CO-m ion&is c nsidered to be a <br /> Development of regional Impact(DRI) and as such is under the Cape Cod Commission <br /> jurisdiction,, meaning procedurally, that the.local process.has been suspended until such <br /> time as the DRI has been completed. There have been some.general (Staff) discussions <br /> with Mr. Storrs regarding the expansion plans for-south of Route 28. Some of the.issues, <br /> for discussion were n v on ept's.. u h as form-based zoning.should it be decided to <br /> engage in a Development Agreement,which could be a three-party agreement.between <br /> the-Applicant/Developer, Town, and Cape Cod Conunissi n. He explained that the intent <br /> -was to bring Cape Cod Commission Staff up to speed on these new concepts and that <br /> Staff`does not have,the ability to hind the Commission in any way. <br /> Mr. I iedwiecki also feels that Mr. Storrs will benefit from hearing about the <br /> .prospective-of the Cape Cod Commission Regional Policy Plan-and how it will impact <br /> his proposed development of this area. These discussions dovetail into what.-has been <br /> expressed by the Twenty First Century Task-Force about attempting to work with <br /> Applicants up front in order to avoid costl legal and engineering expenses when <br /> developing proposed plans. He suggested placing some of these creative land use policy <br /> issues on the table would benefit and inform other communities as well. <br /> Mr. Ti dwiecki -clarified that although he i int-er tod in meeting.and working <br /> with the Planning Board, said discussions are not considered to b official, but more.as a <br /> pre-application for a possible Development Agreement. He is trying to avoid confusion <br /> regarding the-level of discussion at this point, or-to-anything the Commission Staff could <br /> commit to. At this point,discussions are merely-an exchange of ideas. <br /> t this point he deferred to Phil Dcornbe-regarding the procedural steps for <br /> Development Agreement as it would better explain the role of the-Planning Board. <br /> Phil Dascomb explained that should Mr. Storrs choose to prepare a Development <br /> Agreement application, the Cape Cod C.ommission process would begin when said <br /> application is completed (including plans and mitigation). The Commission would then <br /> create a sub-committee to establish a record and conduct public hearings. A sub- <br /> committee was established for M hp a Commons when the MEP process was <br /> completed. when the application has been completed public hearings will be conducted <br /> in Mas-hpee in order to receive input from members of the public or-anyone else wishing <br /> to-express a concern. <br /> I; evelop- meat Agreement regulations specifically allover the sub-committee to <br /> conduct joint-public hearings with local and/or state and federal hoards and agencies for <br /> informational purposes. If the Planning Board is uncomfortabIc with the idea.of joint <br /> meetings they rimy submit.comments for-Onsideration by the sub-committee. During the <br /> hearing process the sub-committee will draft an outline Development Agreement. The <br /> hearing process roust be concluded within 90-days#this deadline may be extended by <br /> mutual agreement. The Commission would look to the Town for feedback on the draft <br /> agreement, perhaps at a j oint:meeting. when the parties.have agreed upon the-fiamework <br /> 2 <br />
