Release of Covenant
Applicant: Willowbend Development Corp.
Location: windy rate Road and Bonnie Blink-Road
Request: Release of Covenant Dated 487. Continued from 4700.
The applicant was represented by Mr. Tom Hardaman. The Planning Department
received a fax from Ilex. Rowley which was presented to the Planning Board, dated
419101, indicating he thinks the amount requested 1,30,000.00 for the covenant
release is OK This amount, not including the cost of the pump station, worts out to be
$333.00 per linear foot of roadway. i111r. Rowley did recommend that final plans be
presented to the planning Board as soon as possible for review and that a condition o
approval be a revised cost estimate is presented to the Board for review at that time.
Additionally,Mr. Rowley-suggested the board would set a time limit and make its usual
adjustment to the covenant release i.e., 1 0 of the amount requested). Mr. Harda man
had spoken with willow bends' Jack Mclhinney regarding the time issue; they feel a
couple of gears to complete is one. Mr. I ardaman also indicated the-sewer design is
almost complete (with hydrants every oo'). Nor. Fudala feels that updated plans should
be included as the current plans are 1987 with no sewer design included. Mr. Malone
suggested the covenant be 1 %of the amount requested and a -year time limit be
specified. Nix. Hardaffmn will get a covenant signed by the board members(who will
come into the Planning Department office to sign sauce) along with a check for$75.
Motion to Release Covenant @ $1,3 0,000 plus 0%,Impose a 2-Year Time
Limit to Complete, & Submit an Updated Set of Plan to the Planning Board
Motion: Dennis al rm* ]* Seconded: Martine Meiwering
Vote: 3-0 Unanimous
Public Bearing opened @,) 7: o PM
Applicant: Janet& Harry Emmons and John & Sandy Hefler7Cape& blands
Location: 80& 84 Punk horn Point road, Assessors Map 100,Blocks 4 &
Request: Approval of -Lot Definitive flan. Submitted 31110
The applicants were represented by Dave Sanicki, Cape & Islands Engineering. The
puns are being submitted because-there is a driveway that encroaches on one of the lots.
Plans are submitted because of a technicality which is the Emmons' do not have
sufficient frontage. There is no change in tentage on these particular lots, which do
show on the plan. The applicants entered into an agreement to sell the driveway parcel if
the Emmons' would sell another parcel on the other side of the Hefler property. Cape
2
