MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> COTUIT SOLAR LLC <br /> 36 Savannas Path(Map 62 Parcel 68B) <br /> Mashpee, MA 02649 <br /> SP-2014-36 <br /> GENERAL CRITERIA: <br /> The subject property located at 36 Savannas Path consists of approximately 65,340 <br /> square feet. <br /> John Bartlett,an abutter that resides at 28 Sampsons Mill Road addressed the Board <br /> and indicated he would like the following conditioned in the Board's decision. He also <br /> requested that public notification be sent on any future changes in zoning. <br /> -The lock box on the gate. <br /> -Limiting the access of construction vehicles through Savannas Path. <br /> -Downward lighting. <br /> -Vegetative boarder. <br /> SPECIAL PERMIT CRITERIA: <br /> Mr. Bonvie stated the plantings for a vegetative buffer would be required unless <br /> Conservation Commission requires a submission for a Notice of Intent. <br /> Mr. Furbush stated no building construction and/or vehicles allowed to use <br /> Savannahs Path from Sampsons Mill Road. The only access allowed is for reconstruction <br /> of Savannahs Path. <br /> The Board conditioned the following: <br /> • Sampsons Mill Road is not to be used as access for any construction vehicles or <br /> private vehicles. <br /> • The gate, with an approved lock, — by the Fire and Police Department must be <br /> installed within thirty(30) days from the date of this approval, and will be 97 feet <br /> from the southermnost point of the lot as shown on the plan, dated December 10, <br /> 2014. <br /> • Hours of operation are to be in compliance with the Town of Mashpee established <br /> hours of operation for construction and the operation of a business. <br /> • Lighting is to remain on site. No lighting shall be on the side of the storage building <br /> which faces the home at 28 Sampsons Mill Road. <br /> • The parking area,facing the residential district must,have a buffer as outlined under <br /> §174-41 K and or L prior to the issuance of an Occupancy Permit. <br /> • Apply for all necessary building permits within sixty(60) days after the approval. <br /> • As stated by the Town Planner (email dated September 19, 2014), no building <br /> permits can be issued on the property until a"Release of Covenant"has been signed <br /> by the Planning Board and recorded at the Registry of Deeds. <br /> 3 <br />
