The Town Planner <br /> informed the Board that the required twenty (20) day appeal <br /> signed off on this period has expired and that the Town Clerk has si <br /> P p g <br /> matter as of January 5, 1999 . <br /> The Vice Chairman noted the date of Approval on the Plan to <br /> be that of December 2, 1998 . He then dated and signed an <br /> original and four (4) copies of said Definitive Plan along with <br /> Board Members Dennis Balzarini and Chance Reichel, (This matter <br /> concluded at 7:13 m p. at which paint the Consulting Engineer, <br /> Charles Rowley, arrived at the Meeting, ) <br /> Discussion <br /> Randy Peters - Assessors Map 69, Block 9713 <br /> Proposed Alternate Access to Lot <br /> The Vice Chairman called this matter to order recognizing <br /> Virginia DeBarros and Randolph Peters. Applicant resented to <br /> p pp p � <br /> the Board and made reference to a very old Plan of Land f <br /> identified as, "Charles N. Savery, Inc. , Registered Engineer - <br /> Survey, Hyannis, Cape Cad - Mashpee" . <br /> Ms. DeBarros made reference to property located off of <br /> s; white' s Path, Lot #4 and Lot #5 . She also stated there are <br /> A approximately six or seven lots in existence. She informed the <br /> L <br /> Board that there has been some interest in purchasing the lots, <br /> but there is no current access into there. <br /> { References were being made to the Plan indicating the <br /> 'location of whites Path, Quine issett Road and Strawberry <br /> � y <br /> Avenue. References were also made to the location of the lot in <br /> question. The Town Planner indicated which roads were paved and <br /> which are non-existent, located within a paper subdivision. <br /> Mr. Peters inquired of the Board his rights to access the <br /> existingright of way, and which issues concerning h g y, g the lots the <br /> Board would like to have clarified. He stated the remainingg <br /> lots,s as shown on the Plan are owned b family y y members. <br /> The Town Planner clarified the lots are considered to be <br /> unbuildable as there is a Covenant in place requiring the road <br /> (white' s Path) be completed or the Covenant be released. <br /> The Town Planner informed the Board that Applicant has been <br /> considering an alternate access in lieu of building white' s Path, <br /> whereupon he would request the Covenant be released. <br /> Applicant noted that his and Ms. DeBarros ' lots are adjacent <br /> and inquired as to the possibility of gaining access from the <br /> k F <br /> f <br /> I <br /> f <br />
