He stated that it is a very
incomplete filing. Mr.Fudala also noted that the Town Clerk's office has a signed
application along with a letter.
Mr.Thomas Fudala stated that they don't quite meet the requirements in the zonin g. He
noted that he has been informed by Town Counsel that, even though the filing is incomplete,
the application cannot be rejected—the hearing still needs to be scheduled.
Mr.Thomas Fudala reviewed the Willowbend Golf Course expansion plans with the Planning
Board.
There was discussion on the issue dealing with the area outside the area of the special permit.
 ';''
Mr.Fudala noted that Willowbend has written in that they are proposing to go to the Zoning
Board of Appeals. He noted that there is nothing in the zoning that provides for the Zoning
Board of Appeals to approve--anything over five acres does not go to the Zoning Board of
Appeals. He commented that this is well over five acres. He added that if you read the by-
''
law for this kind of use, which comes under a"country club",it would either go to the
` ck} }
Building Inspector;or,the other interpretation is that it is an expansion on their original
special permit and it should go to the PI mig Board. Mr.Fudala suggested that Town
:.I' till
Counsel be requested to interpret it for them. Mr.Fudala stated that Willowbend will need to
Board and not the Zoning Board of
go to either the Building Inspector or the Planning
Appeals because it is over five acres.
Mr.Fudala pointed out that under the current rules,he is really not sure who should approve
this;however,if the golf course by-laws are approved at October Town Meeting, they will
apply to this project.
Mr.Fudala noted that the Planning Board has 65 days to hold a public hearing.
to Schedule Public Hearing for Wfflowbend Golf Course:
cation and scheduleI
appli
Mr.Dennis Balzarini made a motion to accept the
the Public Hearing for the expansion of Willowbend Golf Course for
September 15, 1999,at 7:00 P.M.
