TOWN, OF MAIz-HPEt <br /> Town of Mashpee TOWN CLERK <br /> Planning Board 04 APR 2 1 PM 2: 38 <br /> Minutes of Meeting <br /> Executive session <br /> June 1 , 23 <br /> The Town of Ma h ee Planning Board entered into <br /> Executive Session at 9: 45 p.m. on Wednesday, June 18, 2003 . <br /> The Chairman, Beverly -Kane, presided. <br /> Planning Board Members present: Dennis Bal arini, vice. <br /> Chairman; Steve Dolan; Lee Gurney, Associate Member; <br /> Beverly Kane, Chairman; and Don Ayers, Clerk. <br /> Also present: Thomas Fudala, Town Planner; and Eric <br /> Smith, Assistant Town Planner. <br /> The Chairman entertained a motion to enter into <br /> Executive Session for the purpose of discussion of pending <br /> litigation. <br /> MOTION: Dennis Bal arini made a Motion to enter into <br /> - - -Exeoutive -S es-s-ion- not-=t - -retuâ–ºrn. too regu-Ia- - -seas-ion--- fe-r <br /> the purpose of discussion of pending litigation which <br /> Motion- was seconded by Dan Myers . <br /> Voting in favor: Dennis Balarini., Beverly Kane, Steve <br /> Dolan, Lee Gurney, and Don Myers . <br /> The Town Planner reported Town Counsel has decided to <br /> take a more aggressive stance with Mr. Connolly. The <br /> Depositions have been cancelled. Town Counsel is preparing <br /> to file a Protective Order, as well as a motion to dismiss <br /> the 1 . 5 million dollar claim on the grounds it I.S. <br /> considered to be frivolous. <br /> There was some discus-s-ion as to whether or not an <br /> offer has been made to dismiss the appeal of the variance <br /> decision if the lawsuit is dropped. <br /> Adjournment <br /> There being no further Executive Session diou .io , <br /> the Chairman entertained a motion to adjourn. <br /> 1 <br />
