MASHPEE ZONING BOARD OF APPEALS <br /> Marjorie Hackett and Robert Hackett <br /> 10 Stanley Road (Map 114 Parcel 88) <br /> Mashpee, MA 02649 <br /> FINDING-2013-3 8 <br /> Specific Written Findings: <br /> The Board determined that the proposal shall not be substantially more detrimental <br /> than the existing non-conforming structure or use to the neighborhood, as defined under <br /> Section 174-27 of the Zoning By-laws, and contingent upon the following:. <br /> • Board of Health Title 5 site approved septic plans. <br /> • The applicant's order of conditions must be approved by the Conservation <br /> Department as noted in this comment: "The homeowners will need to file a Notice <br /> of Intent with the Conservation Commission for the demolition/rebuild of the <br /> existing home. A portion of the property lies within 100 feet of the top of coastal <br /> bank and the property is also within the 100 year floodplain". <br /> • Revised plot plans signed by a registered land surveyor and engineer for the <br /> proposed dwelling at 10 Stanley Road, Mashpee, MA, and the same signatures by <br /> the land surveyor include the elevation plans with the same data on the proposed <br /> site plan confirming the height. <br /> • Has sufficient parking and setbacks as may be required. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> September 11, 2013, the Zoning Board of Appeals voted unanimously to grant a Written <br /> Finding to allow for the proposal. This Decision is contingent upon compliance order of <br /> conditions from the Conservation Commission and approval from the Board of Health. Is <br /> contingent upon revised plans to include signatures by a registered land surveyor and <br /> engineer for 10 Stanley Road, Mashpee, MA, and the same signature by the land surveyor <br /> sign to include the elevation plans with the same data on the proposed site plan confirming <br /> the height. Also, is contingent upon the proposed site plan for Robert Hackett prepared by <br /> JC Engineering, Inc. 2854 Cranberry Highway, East Wareham,MA 02538, scale: 1' =20', <br /> dated August 13, 2013, Rev. 1: dated 9-11-13 (House size and egresses). The architectural <br /> plans for client: Bob Hackett, job location: 10 Stanley Road, Mashpee, MA 02649, <br /> designed by CBC Design Group Clark Balser Clarke consisting of CS-100 to DW-100, and <br /> signatures by a certified land surveyor and/or engineer to include the elevations on the site <br /> plan and indicate the building height is less than 35 feet or less. Issuing said finding, the <br /> Board finds the dwelling not substantially more detrimental than the existing non- <br /> conforming structure and the new dwelling will be an improvement and conform to current <br /> building code requirements. It is comparable in size and character to other structures in the <br /> neighborhood, and has sufficient parking and setbacks as may be required. <br /> 'w <br /> 3 <br />
