Mr. Fudala reported that sprinkler issues had <br /> not fret been addressed so Mr. Bornstein was requesting a continuance to a later date. <br /> MOTION: Als. Waygan made a motion to continue the'7: o p.m. public hearing to March 4 at <br /> 7:10 p.m. Mr. Kooharian seconded the motion. All voted unanimously. <br /> RELEASE OF PERFORMANCE GUARANTEE <br /> Applicant: Peter& Jane Chin Ralph Secino, agent <br /> Location: 35 Fox Hill Road <br /> Request: Release of road covenant,on Lot 35 of Conaumet Highlands subdivision <br /> Mr. Fudala reported that Mr. Secino called requesting an extension as he was awaiting a more accurate <br /> cost estimate of engineering puns for the drainage system. Dave 'Torres, interested in purchasing the <br /> lot, was troubled that the Board was holding the owner responsible for repairing the road. Mr. Fudala <br /> explained the road covenant and stated that the developer in the 's violated the covenant by selling <br /> the lots without a release, leaving people with unbuildable lots. Over the gears, as people sought <br /> covenant releases, the Planning Board has required that proper owners tape on the responsibility of a <br /> fair share of-road construction. Mr. Rowley shared pictures of the area, showing the road.in poor <br /> condition and described the work to be completed. Mr. Rowley r will follow up with Cape& Islands <br /> Engineering. A joint meeting was anticipated With the Board of�Health and <br /> Conservation Commission to further discuss implementation of the bylaw. Waygan made a m tion to approve payment of$230 for the Land Court <br /> Reporter subscription. Mr. Kooharian seconded the,emotion.
