Update—Road Takings <br /> The Chairman reported on a meeting conducted in August, at which time a change <br /> to the general Bylaw was proposed. In part said change-would state that roads would <br /> have to comply with,Planning Board Mules and Regulations. <br /> The DPW Director, Catherine Laurent, is-in agreement only with respect to the <br /> paving width and thickness. She suggested that the amendment Mate that regulations <br /> only apply to paving.width and thickness where practical. <br /> The Chailm n has suggested that Town-Counsel be asked to make a <br /> determination of Section 41. <br /> The Consulting Engineer provided information on related court cases, which <br /> determination was satisfactory to the Planning Board. The Supreme Court upheld the <br /> initial ruling by a.fudge, in favor of the Planning Board,that the only time a Town <br /> must comply with the Subdivision Rules and Regulations is when there is a new street <br /> layout beixig proposed; not necessarily for streets taken from a subdivision previously <br /> approved. The final Decision did,however, address the level of work being done. <br /> The Chairman further reported that the DPW Director will appear before the <br /> Environmental Oversight Committee in order to address the issue of stormwater <br /> management for Santuit Ponta and Town road takings: <br /> Adjournment <br /> There being no norther Planing Board business to address the Chairman <br /> entertained a motion to adjourn. <br /> MOTION: Denm' 's Balzarini made a Motion to adjourn the Meeting; which <br /> Motion was duly seconded by David I ooharian and so voted unanimously. <br /> (The September 9, 2 010 Pla m"ng Board Meeting was thereupon adjourned at <br /> 10:4 P.
