The SPCA may require that applicant to establish <br /> an interest bearing escrow account or other surety at the <br /> SPGA' s election at the time of construction to cover costs <br /> f the removal in the event the Town must remove the <br /> facility. The amount of such surety shall be equal to 10° <br /> f the cost of compliance with this section. The applicant <br /> shall subm-it a fully inclusive estimate of the costs <br /> associated with removal. The amount shall include a <br /> mechanism for cost of living adjustment every f ive- <br /> years. The amount shall remain with the Town in perpetuity <br /> or until the WECF is removed to the satisfaction of the <br /> Bu- ilding Inspector. Any remaining balance in the escrow <br /> account after removal and disposal of the facility shall be <br /> returned to the applicant. " <br /> It was the general consensus of the Board to seek Town <br /> Counsel opinion regarding the requirement of an applicant <br /> to provide a bond, surety, or escrow account under the <br /> .zoning bylaws. <br /> There being no further discussion the chairm n <br /> entertained a -mot-ion. <br /> MOTION: Dennis Balzarini made a Motion to authorize <br /> the submission of the proposed Zoning Bylaw for Land-based <br /> Wind Energy conversion Facilities, as amended this evening <br /> and subject to Town counsel opinion regarding the matter of <br /> security to Town Meeting; which Motion was duly seconded by <br /> Thomas O' Hara and so voted unanimously. <br /> Discussion - KennelBy-Law <br />
