T # <br /> The Chairman- recognized Don Megathlin, representing <br /> Applicant, who first reported on South cape Village. It is <br /> his hope that the Planning Board is pleased with the <br /> Marshall' s Building elevations and those of Buildings c and <br /> D as well . He mentioned landscaping efforts stating that <br /> seventy trees have been delivered and planted. <br /> Mr. Megathlin stated that he has been working closely <br /> with the consulting Engineer with reference to inspections <br /> to the sidewalks, curbs, and parking areas . <br /> The anticipated opening date for the Mars-hall's store <br /> is May 22, 2006. The traffic light will be operational for <br /> what is known as "flashes." on April 14 11h for approximately <br /> three/four weeks after which time the light will become <br /> permanent by May 3 d. Lowell Road -ha-s been completed <br /> according to the subdivision plan approved by the Planning <br /> Board. The first binder course has been completed, and <br /> will be l named and seeded in early May. The final birder <br /> will be completed by early May and Applicant has agreed to <br /> install a conduit for a future signal) . <br /> M.r. -Megathlin then reported on the wastewater <br /> treatment plant * He explained that their permit has <br /> expired and that they have reapplied to DEP. The process <br /> takes several months to review the application and inspect <br /> the property. <br /> Mr. Megathlin stated he would notify the Board of <br /> Health and the Town Planner of the inspection date. <br /> With reference to the letter of non-compliance <br /> Applicant has received from DEP. Mr. Megathlin reported <br /> that all of the items of concern have -been corrected, and <br /> were primarily maintenance and operational issues . <br /> r. gathlin reported that the readings h` ve greatly <br /> improved (below DEP requirement of to ppm) and that it is <br /> expected that DEP will respond favorably to the Weston <br /> Sampson report . Again, Mr. Megathlin stated his intent to <br /> provide copies to the Board of Health and the Town Planner <br /> of said DEP report . <br /> Mr. Megathlin then addressed the matter of Planning <br /> Board standard of 5-ppm nitrate reduction. He made <br /> reference to a report provided by Weston & Sampson <br /> Engineering dated March 2 , 2006. <br />
