The Town Planner informed the Board that a request has <br /> been made for release of Lot 1 without being required to <br /> construct any portion of the road. <br /> r. Rowley has indicated that particular segment of <br /> the road adjacent t.o the lot should be secured, or require <br /> a performance guarantee in are amount certain as specified <br /> by a contractor, as is cone with any other covenant <br /> release. <br /> The Chairman recognized Helena D' ngelo, who stated <br /> there are currently two hones using the access provided. <br /> At this point the Chairman read a portion of Mr. <br /> Rowley' s comment (fax) letter, dated April 1 , 2006, "...It <br /> is ray opinion that the covenant can be released for Lot 1 <br /> only if the terms of the covenant have been fulfilled, that <br /> is either the road is constructed or security is posted in <br /> an amount sufficient in the opinion of the Planning Board <br /> to cover the costs of construction. This latter option has <br /> been traditionally to of the amount shown on a <br /> responsible contractor' s letterhead after the construction <br /> items and costs for each has been reviewed and approved by <br /> the Board. The posted security typically also has <br /> unlimited amount of time attached to it before the Planning <br /> Board can call in the security and have the construction <br /> completed by the Town of Mashpee. The Planning Board can <br /> also decide to release Lot 1 upon receipt of security for <br /> the construction of that portion of the approved road that <br /> would provide access to Lot 1 only and leave the remaining <br /> lots under the covenant for release at a later date. " <br /> Ms . D'Angelo stated she would not want to <br /> unnecessarily have to construct something. she described <br /> the current roadway as a "charming country road" with a <br /> farm located at the end -of the drive. <br /> Dennis Bal arini agreed, stating however that the <br /> Board is concerned with the -subdivision/sale of lots and <br /> the responsibility to provide proper access . <br /> The Town Planner asked if Lot 1 would be made <br /> available for sale. <br /> Ms . D'Angelo replied, "...If it is necessary <br /> financially, then yes..." <br />
