There- was n Public comment. <br /> Article 23 Explanation - Since 1979, cluster <br /> subdivisions have required a. special permit that, under the _ <br /> provision' s of the General Laws, freezes applicable zoning <br /> on the lots in the subdivision as of the date of approval <br /> of the special permit. This article would "grandfather" <br /> building lots approved by the Planning Board under <br /> provisions of t-he zoning by-law in place during the 197b' s <br /> that allowed the Board t-o approve cluster subdivisions <br /> without the requirement for a special permit. The <br /> protection afforded by the article would be with regard to <br /> minimum r quired lot size., frontage and building setbacks, <br /> but not to other portions of the zoning by-law such as <br /> height, lot coverage, stor water management, etc. <br /> The Assistant 'down Planner informed the Board of a <br /> recommendation submitted by the Cape cod Business <br /> Roundtable, signed by Elliot Carr, Moderator, dated <br /> September 12, 2006, recommending approval of the article. <br /> "...In summary, we believe the proposed amendments <br /> represent a forward thinking approach to utilizing cluster <br /> layouts and may provide a u. efu.l model for other Cape cod <br /> communities, " <br /> There was no Board or Public comment . <br /> Article 24 Explanation - This article is intended to <br /> update the stormwat r manager e t by-law adopted in 1999 by <br /> specifying additional practices and facilities which appear <br /> to be effective in reducing nitrogen in runoff, deleting <br /> reference to certain facilities which have -not proven <br /> effective and providing additional design guidance <br /> regarding volume of flows required to be treated, The <br /> article also renumbers the section to move it to a more <br /> appropriate section of the zoning by-law. <br /> There was no Board or Public con nent. <br /> Article 25 Explanation - This article is intended t <br /> update the cu-rrently allowed use "laboratory or research <br /> facility" by specifically including software development <br />
