He asked that this issue <br /> be resolved, a deed restriction for the open space to be <br /> filed with the State Division of Conservation Services in <br /> order to define the boundaries of the open space. <br /> Attorney Schaeffer made reference to section H of the <br /> Special Permit, ,....perma-nently restricted pursuant to the <br /> proposed master deed...". He stated there is nothing in the <br /> Special Perm- it that requires a conservation restriction. <br /> The Chairman referred to statements made by Mr. <br /> Fudala, that, there -should be a registration with the State <br /> Division of Conservation, which has not been done. <br /> Attorney Schaeffer argued that this issue is not <br /> mentioned in the Special Permit, but that he is receptive <br /> to discussion reg rding a State registration. He commented <br /> however that this i-s a new issue, a. separate issue, and has <br /> nothing to d with the original Special Permit . He also <br /> stated tht this matter was nearer, addressed by the original <br /> developer and that this is a new matter that has just come <br /> to his attention. <br /> Lee Gurney referred to Section H of the Special Permit <br /> that states that the -acres of open space as shown on the <br /> Site Plan shall be permanently restricted. She suggested <br /> that perhaps there has been a miscommunication regarding <br /> this is-sue. <br /> The Chairman suggested that "if in fact this is a <br /> violation of the Special Permit, it should be resolved <br /> prior to any further Planning Board action. <br /> The Chairman then asked if the: open space is bounded. <br /> r. Fudala responded there are no definitive plans of <br /> the open space. There is a condominium master plan that <br /> has not been recorded in terms of open space boundaries . <br /> Ir. Rowley steed that the open space has never been <br /> physically bounded in the field. <br /> At this point the. Chairman reviewed the issues at <br /> hard. open space boundary/registration with the State <br /> Division of Conservation, Planning Board request that only <br /> organic fertilizers be used in this project, and that the <br /> Consulting Engineer concerns be addressed to his <br /> 13 <br />
