3. The time for performance shall be January 9, 2001, provided applicable appeal <br /> Periods relating to permits issued have expired. If such appeal periods are pending then <br /> performance shall occur on the tenth(10`") day following such expiration date. However <br /> if the BUYER is unable to procure said permits and approvals, before the original Time <br /> for Performance, the parties shall mutually agree to extend the date for performance an <br /> additional five (5) months to June 9, 2001. After January 9, 2001 and up to the date of <br /> performance the BUYER shall pay to the SELLER a monthly interest payment, in <br /> arrears, of$3,391.00 based upon the balance of the purchase price($440,000.00) at an <br /> annual interest rate of 9-1/4%. The parties agree to pro-rate said monthly payment in the <br /> event the date of performance falls on a day of the month other than the 9t°. <br /> 4. The BUYER is hereby given permission to proceed before all government <br /> entities/authorities, as named in 1(a) of this addendum, for the purpose of procuring all <br /> approvals and permits for the self storage business intended to be constructed by the <br /> BUYER.
