Miller for a Finding of Fact <br /> under Section 174-17 of the Zoning By-laws regarding continuance, extensions and <br /> alterations to allow for installation of footings with alteration of an existing deck on a <br /> pre-existing, non-conforming structure on property located in an R-3 zoning district at 44 <br /> Little Neck Lane (Map 105 Parcel 13) Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 20, and May 27, 2011 <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on June 8, <br /> 2011. The following members of the Board were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell and James <br /> Reiffarth, and Associate Member Ronald S. Bonvie. <br /> Mr. Sean Dicataldo represented the Petitioner and stated that the proposal calls for <br /> installation of new footings to the deck. The deck will then be cantilevered an additional <br /> two feet past the footings. Four of the footings will be installed 10 feet away from the <br /> concrete foundation of the house and two of the footings will be installed 14 feet away <br /> from the foundation. Mr. Dicataldo said that the deck footings will be placed close to the <br /> retaining wall, not on top of it. The rest of the deck will be cantilevered. <br /> Acting Building Commissioner Charles R. Maintanis confirmed that a deck can <br /> be cantilevered. He will conduct an inspection of the deck to certify that it meets the <br /> building code. <br /> The Conservation Commission approved the Petitioner's application for Request <br /> for Determination of Applicability (RDA). <br /> After some discussion, the Board determined it would not require a signed and <br /> stamped engineering plan for this Petition. <br /> No comments were received from abutters. <br />
