'd:t s', .tt Fte e�;.t"�I`•ti 0��� �.SJ <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2011-19 <br /> Robert D. and Grace Varney Map 41 Parcel 56 <br /> 64 Hilltop Road Registry of Deeds Title Reference: <br /> Mashpee,MA 02649 Book: 18660 Page: 106 <br /> A Petition was filed on May 12, 2011 by Robert D. and Grace Varney for a <br /> Special Permit under Section 174-45.4 of the Zoning By-laws for permission to construct <br /> an accessory apartment in an existing home on property located in an R-5 zoning district <br /> at 64 Hilltop Road(Map 41 Parcel 56)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 20, and May 27, 2011 <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on June 8, <br /> 2011. The following members of the Board were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell and James <br /> Reiffarth, and Associate Member Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. and Mrs. Varney represented their Petition. Mr. Varney said that their <br /> proposal meets all the By-law requirements for grant of a Special Permit allowing for an <br /> accessory apartment. The accessory apartment will be constructed in the basement of the <br /> existing home. At 517 square feet, the proposed construction will be a little less than <br /> 33% of the total square footage of the 1600-square foot home. There are three means of <br /> egress for the apartment. There is sufficient parking on the property. <br /> Mr. Nelson said that he visited the property and was quite impressed by the <br /> immaculate and well-kept property. He also stated that the exterior appearance of the <br /> dwelling is that of a single-family home. <br /> Acting Building Commissioner Maintanis explained that the Building Department <br /> keeps records of all homeowners who have legalized their accessory apartments. He said <br /> that on an annual basis the Building Department mails paperwork to the property owner. <br /> The property owner must submit sufficient evidence to the Building Department <br /> demonstrating the property owner's occupancy of the principal dwelling unit. <br /> The Board of Health has approved the proposal, contingent upon a septic <br /> inspection. Mr. Maintanis said that the Fire Department and the Building Department <br /> will schedule a joint inspection of the dwelling. <br />
