_ **Vote: All in favor of the motion: 4 in favor, 1 opposed.** The Board closed the public hearing Public Nearing: Zoning articles for May Town Meeting. *Bev made a motion to dispense with reading of the article. Dennis seconded the motion - * 1. To allow drive through indows in C-2 districts. Subrrnitted by petition. Toni Currently drive throughs are allowed in C-1. C-2 which is the west side of Rte 130, area around And 's market, old Barnstable and 151 and area around Botelhos. All current give throughs are illegal,this would mare then legal. The LCP recommends the area around And 's and Botelhos, not the others, but with provisions that are not in the petition article. The petitioner,Paul La aro was present. He is the operator of the Shell station on 15 1. He spoke with Honey Dew donuts who would like to-move to that location if it could have a drive through. They are only allowed with a special permit at that site. Public Comment: Sp ro Mitro ostas: first,he would argue the current windows are_legal because the Board granted them a special permit. (Tom responded that the ZA issued the permit but learned after the fact that the drive throughs,were not allowed.) Spro said this change would allow drive throughs by right in all those areas and all will come forward to request one. The town could see applications of 3 per month. Also, HoneyL ev is presently a tenant and has not intention of leaving that drive through window cation. He asked the Board to deliberate seriously on this issue. Torn mentioned that drive throughs are now only allowed for banks. This petition would allow therm with a special permit, granted by either ZBA or Planing Board depending on the size of the • project. Board Comments; Dennis thinks this will open a can of worms. Beverly asked ghat happens if the Board does not recommend? Torn explained it's a recommendation for town meeting; the voters can then either agree or disagree with the Board's recommendation. ** Beverly made a moti on not to recommend this article. Dennis seconded the motion. All members were in favor ;o** . Article, submitted by petition. Dick Terror stepped down and left the room. Tom explained it was first submitted last summer, missed the October warrant. This tie, the petitions is deficient because there was no zoning article attached. It cwmot.be acted on by town meeting. The petitioner Will request the article be indefm tely postponed at town meeting. The PI n.r img Board can vote to indefinitely postpone it tonight as the recommendation to town meeting. 5
