The cages are structures within <br /> the meaning of the definition. The Building Inspector's determination to the <br /> contrary is erroneous. <br /> D. The Proposed Use Is "Development" Within The Scope Of Section <br /> 174-62 Of The Bylaw. <br /> Section 174-58 sets forth provisions that are applicable to the Zoning <br /> Bylaw's Floodplain Provisions. In pertinent part, this section defines <br /> "development" in floodplain areas as "any man-made change to improved or <br /> unimproved real estate, including but not limited to buildings or other <br /> structures, mining, filling, grading, paving, excavation or drilling operations, at <br /> or below the base flood elevation as specified within the A and V Zones." <br /> (Emphasis added). <br /> As set forth above, Mr. Cook's proposal is to install 3,000 wire mesh <br /> cages in a V Zone and to affix them to the bottom with 100 cables, 200 anchors, <br /> 3,000 loop connectors and 12,000 stand off pipes. He further proposes to <br /> actively maintain his aquaculture operation with hundreds of man hours of work <br /> every month. This proposal certainly constitutes a "man-made change" to land <br /> below the base floor elevation in V Zone. The Building Inspector's <br /> determination to the contrary is erroneous. <br /> CONCLUSION <br /> Based upon the foregoing, we respectfully request that Board of Appeals <br /> reverse the Building Inspector's determination as it is erroneous. Further, we <br /> request that the Board of Appeals determine that Mr. Cook's proposed <br /> aquaculture grant is not permitted under the Mashpee Zoning Bylaw. <br /> 16 <br />
