have a signifiicant adverse impact on wildlife habitat, estuarine systems, traffic, flow, traffic -
<br /> safety, waterways, fisheries, public lands or neighboring properties, will not cause excessive
<br /> levels of noise, vibrations, electrical disturbance, -radioactivity or glafe, rill not destroy or
<br /> disrupt any species listed as rare, endangered or threatened by the Massachusetts Natural
<br /> Heritage Program or any mown historic or archaeologic site, will not produce amounts of trash,
<br /> refuse or debris in excess of the Town's waste disposal capacities, gill properly dispose of
<br /> stumps, construction debris, hazardous materials and other waste, will provide adequate off-
<br /> street parking, will not cause excessive erosion or cause increased runoff onto neighboring
<br /> properties or into any natural river, stream, pond - r grater body and will not otherwise be
<br /> detrimental to the Tern or the area. An applicant.should present,sufficient evidence to allow
<br /> the Board to make such determinations.
<br /> N. Failure by the Board to tale final action within said ninety days. or extended time, if
<br /> applicable, shall be deemed to be a grant of the special permit. Final action, as used here, is
<br /> the.filing of the Board's decision with the Town clerk. Any applicant rho seeps such approval
<br /> by reason of the failure of the Board to act within the time, prescribed shall notify the Town
<br /> Clerk, in writing, within fourteen days from the expiration of said ninety days or extended time,
<br /> if applicable, of-such approval and that notice has been seat by the applicant to all parties in
<br /> interest. The applicant shall send such notice to the parties in interest by mail, -and each such
<br /> notice shall specify that appeals, if any, shall be made pursuant to chapter 40A, Section 17 Of
<br /> the General Laws and shall be filed within twenty days after the date the Town Clerk received
<br /> such written notice from the applicant that the Board failed to act within the time prescribed by
<br /> the General Laws.
<br /> After the expiration of twenty days without notice of appeal to the Barnstable County Superior
<br /> Court, or, if an appeal has been taken, after'-receipt of certified records of the superior Court
<br /> indicating that such approval has become fir-al, the Town-Clerk shall issue a certificate stating,
<br /> the date o approval, the fact that the Board failed to take final action and. that the approval
<br /> resulting from such failure has become final, and such certificate shall be forwarded -to the
<br /> applicant.
<br /> o. The Board will cause to be made a Special Perrnff Dedsion or Special Permit Modification
<br /> Decision) document, including a detailed record of its proceedings on the application setting
<br /> forth clearly-the reason for its decision and offts official actions, its findings, any conditions on
<br /> an approval and any attachments, and indicating the vote of each member on the decision, or if
<br /> absent or failing to vote, indicating such fact, copies of which shall be filed within fourteen days
<br /> of the Board's vote in the office of the Tern cleric and shall be deemed a public record, said
<br /> document may also include notice of'when the permit will lapse, as well as signature limes for-'a
<br /> representative. of the Board indicating that the document is a true copy as approved by the
<br /> Board, for the Town Clerk's certification of the date the decision document 'vas filed, of the
<br /> date-that notice was mailed to,the parties in interest.and that no appeal of the Board's-decision
<br /> was filed within twenty days of filing the decision document or that any appeal has been
<br /> dismissed or denied, and for signature by the members of the Board after the latter certific ation
<br /> by the Torn Clerk.
