Sykes <br />Dam 10 10 02 <br />[a: Filing Process for ANR Plans <br />► plan was recently left at the Planning Department office by an employee of Robb B. Sykes <br />of Eastbound Lead Surveying, Inc., nerved Mary Ellen, proposing to divide land owned by <br />Norman J. Dias. she was informed that the Department did not accept plan filings and that <br />the plan would have to be filed at the next Planning" Board meeting, as required by the <br />Planning oardrs subdivision regulations. <br />The Planning Department staff reviewed the ,materials submitted to determine their <br />completeness and informed the surveyor that a number of items were ,Hissing, including the <br />latest recorded deed to the property. These items. were later submitted to the Departrnent. <br />n the day before the next Planning Board meeting, the Assistant Planner received a fax <br />addressed to the Planning Board Chair indicating that the surveyor was `unable to attend <br />the hearing due to a scheduling conflict". The Assistant Planner spoke to Mr. Sykes on the <br />phone that afternoon indicating that he didn't see any ,major problems with the plan but that <br />he had to speak to me about it. <br />When l was informed of the issue on the day of the meeting (September 1 1 called Mr. <br />Sykes' firm. As no one answered, I left a message that any ANR Plan had to be submitted <br />to the Planning Board at their meeting by the owner or his representative, that the Planning <br />Depar rent staff could not act -as the owner's representative. I also indicated that if Mr. <br />Sykes could not attend the ,meeting then someone else representing the owner would have <br />to attend to make the submission or ft would have to be postponed to the next regularly <br />scheduled Planning Board meefing on October 2. I also indicated that l was particularly <br />relu' ant in this -case to present the pram to the Board as there appeared to be significant <br />discrepancies between the property boundaries described on the plan and the property <br />description contained in the deed submitted therewith. <br />Mr. Sykes has objected to this situation in that'he is upset that the Planning Department staff <br />did not submit his plan for him to the Planning Board, that "everybody else" does ft differently <br />and that the subdivision statute he claims) specifies that an ANR filing can be ,made with <br />the Town Clerk. He also objects to my concems about the discrepancy between the <br />property boundaries described in the plan and in the deed. These concerns were <br />expressed in a phone conversation on the 1 " in which I disagreed with his interpretation of <br />Page 1 <br />
