needed in this area. <br /> Attorney Singer also suggested that should the Hearing <br /> proceed this evening and be continued to another date, efforts <br /> made by the Board and the Public may be In vain should the <br /> pending court cases be resolved against the Commission decision. <br /> He suggested the period of time between this date/Hearing and <br /> said court decision could be quite lengthy. Should this prove to <br /> be the case, informationtestinmony in this matter could become <br /> stale in everyone' s memory. He suggested the Board be prudent <br /> and continue the Hearing now that it has been opened. <br /> The Town Planner clarified his position that the Hearing <br /> should be opened in order to meet Statutory regulation; whether <br /> or not testimony is taken now or upon resolution by the courts <br /> is entirely a Board/Applicant matter. <br /> Attorney Denney stated he feels there are serious issues to <br /> be considered in the appeal made by W. Watts. He is not of the <br /> opinion that Mr. Watts is an aggrieved party, but rather this is <br /> an ethic defy to his Applicant ' s proceedings- in order to provide <br /> Mr. Watts more time to "catch up" . <br /> Consideration has been given by the Commission to the Watts <br /> tower (Assistant Town Planner was present at this meeting) . It <br /> was clarified at this time that should one of the proposed towers <br /> on Echo load not be approved, and should the Watts tower be <br /> constructed, there will remain a .need for a tower to the south of <br /> the Watts tower. However, should one of the towers be approved <br /> for Echo Road, it is a possibility that the Watts tower would not <br /> e necessary. <br /> Attorney Singer then asked the Board/Applicant to consider <br /> the fact that should it become necessary to continue this matter <br /> for some months, only those Board members who have heard all of <br /> the testimony would be able to Grote on the Special Permit. <br /> t this point the Chairman addressed the Applicant with the <br /> choice proceeding with a presentation explaining the Board i <br /> receptive to nearing testimony. <br /> The Chairman recognized Donald Cody, Director of operations, <br /> Industrial om uni cations, who stated he feels it is quite clear <br /> that there exists another competitive entity from another town <br /> mating an attempt to construct a tower-. The Cape Cod Conissio <br /> has stipulated certain conditidns, some of which include that <br /> this Applicant must successfully complete a review/approval roval from <br /> the Town. Also, i <br /> certain number f carriers must a n place, <br /> as well as an open space donation made to the Town of Mashpee. <br /> Preliminary approval by the Cape Cod Commission will not be <br /> issued until all conditions have been satisfied. The Commission <br /> is unable to issue as long as the initial process remains under <br /> appeal . Regardless of the Tow ' s decision, it will <br /> -4- <br />
