• <br /> deters-ned there should not as the matter has been <br /> officially referred to the Cape Cod Commission. <br /> The Chai man entertained a motion be made in the <br /> natter of New Seabury Properties LLC/BSS Design. <br /> MOTION: Dennis Bal arini made a Motion to refer the <br /> natter of New Seabury Properties LLCBSs Design to the Cape <br /> Cod Commission, based upon recommendation mule by Town <br /> Counsel; which Motion was seconded by Steve Dolan. <br /> Voting in Favor: Beverly bane, Dennis Balzarini, and <br /> Steve Dolan. <br /> Opposed: Don Mye.r.s, and Richard Terry. <br /> Public Hearing <br /> indchime Point, Inc. - windchi a Point Condominium <br /> Approval of Modification to Special Permit <br /> The Chairman opened the Public Hearing in this matter, <br /> acknowledged receipt of information prepared by Applicant' s <br /> engineer. <br /> The Town Planner explained there had been some <br /> confusion with the plan used for calculating. The Building <br /> Inspector determined the swinufting wool would be considered <br /> a structure. Applicant agreed to re-examine configuration <br /> of the buildings, and the possibility of eliminating the <br /> middle garages in an attempt to remain within the ten 10 ) <br /> percent zoning. <br /> The Chairman recognised Attorney Taipale who spoke to <br /> the definition of "structure" and „building" as it relates <br /> to the Special Permit. He also raised concern regarding <br /> the accuracy of the site plan front ,which the orig-Inal <br /> figure of 178, 100 was calculated. <br /> The structure area has been recalculated to 1 , 0 , <br /> which would allow an increase of 20 , square feet.. <br /> References were being made to the Calculation Tables <br /> provided by Applicant . Attorney Taipale provided a <br /> chronology of the special Permit. Where was reference to <br /> the Zoning By-lair amendment 10 limitation, <br /> Attorney Taipale addressed the importance of the <br /> Zoning amendment as it relates to the Special Permit. <br /> 6 <br />
