However, an argument can be made that covenants would be rewired statutorily. At this point the Chairman asked for Board comments, there was discussion regarding review 'g g e iew of the history of this matter. with references being made to Attorney McLaughlin' s letter. Chance Reichel asked what is expected to be accomplished at this Meeting. In response, the chairman suggested perhaps a clarification of Applicant ' s case. He stated that he personally ' ' would require time to review the � e document presented, aided by the advise of Town Counsel . He reminded Applicant of the Board' s request h previous equ st t at Town counsel be given the opportunity for ,t response. Ilk The chairman clearly stated his preference to withhold a ;y, decision pending Town Counsel ' s advice, as well as feeling ; f4 remiss in addressing the Covenant of Release, transferring what was originally a Planning Board matter to the Building Inspector ► `.�'�� due to its complexity. All Board Members were In agreement. r Dennis Balzarini asked if Building Permits have been issued. In addition, three (3) Building Permits M! have been issued, the Certificates of occupancy for which cannot be issued without the Release of Covenant. Responding to a question asked b the Town Planner Ed ,Mw p g Y Stafford reported he is in possession of three (3) Building Permits and two (2) curb-cuts . k The chairman reiterated his desire to await a decision from ,. Town Counsel before proceeding further in this matter. The Release of covenant in this matter was then continued to 7 :15 p.m. on February 4, 1998 . Steve Giatrellis-52 in Ma Street Potential commercial/Industrial Subdivision and zoning Amendment ;_E �4 t The chairman recognized Mr. Giatrellis, who identified himself for the Record as Stephen Giatrellis,i s and resented a � p r P Plan entitled, Plan of Land located in Mash pee, MA, Prepared for Steve Giatrellis, Dated January 20, 1998. Mr. Giatrellis made references to the Preliminary Plan, which he submitted for the purpose of receiving feedback from the z Board.
