Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 9 and April 16, 2010, a copy of which is <br /> attached hereto and made a part hereof. <br /> This Petition was continued from the April 28, and May 26, 2010 Public Hearings to <br /> allow the Petitioner an opportunity to submit revised plans. A final Public Hearing was held on <br /> the Petition at the Mashpee Town Hall on June 23, 2010. The following members of the Board <br /> were present and acting throughout: Board Members Robert G. Nelson, Jonathan Furbush and <br /> William Blaisdell, and Associate Members Peter Hinden and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions <br /> of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Architect Mark R. Marinaccio represented the Petitioner. Mr. Che Franklin, the <br /> Petitioner's son, also attended the meeting. The proposal calls for addition of an accessory <br /> apartment to the home. The gross floor area of the proposal will be 37.5% of the gross floor <br /> area of the house,below the 40%maximum allowed under the By-laws. <br /> Mr. Marinaccio said that the lower deck and pool deck will be changed to patios and the <br /> upper deck will be reduced to 75 square feet. This will bring the proposal to 20% lot coverage. <br /> With two of the bedrooms being combined and proposed construction of the one-bedroom <br /> apartment, the dwelling will remain at a total of three bedrooms. The dwelling is restricted to a <br /> maximum of four bedrooms. <br /> There will be adequate parking with four parking spaces along with garage space. <br />
