MASHPEE ZONING BOARD OF APPEALS <br /> David and Trea Alves <br /> 52 Lowell Road <br /> Mashpee, MA 02649 <br /> V-10-14 <br /> GENERAL FINDINGS: <br /> that the subject property is located at 52 Lowell Road and consists of 11,953 <br /> square feet of land. <br /> SPECIFIC FINDINGS: <br /> The Board finds that: <br /> 1. owing to circumstances relating to the shape and topography of such land or <br /> structures and especially affecting such land or structures but not affecting <br /> generally the zoning district in which it is located, a literal enforcement of the <br /> provisions of the ordinance or by-law would involve substantial hardship, <br /> financial or otherwise, to the Petitioner. <br /> 2. desirable relief may be granted without substantial detriment to the public good. <br /> 3. desirable relief may be granted without nullifying or substantially derogating from <br /> the intent or purpose of such ordinance or by-law. <br /> 4. the proposal will remain well below the 20% lot coverage requirements. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on April 28, 2010 <br /> to grant a Variance of ten(10) feet from the southerly lot line. <br /> This Decision is conditioned upon compliance with John P. Doyle, Land Surveyor <br /> plan entitled: "Foundation As-Built Plan Prepared for David and Trea Alves 52 Lowell <br /> Road Mashpee, MA., Scale: 1"=20' April 25, 2007". <br /> 2 <br />
