yr <br /> also stated he has a concern f <br /> regarding the PlrazlI�.lrlg Board vax''ya�.ng r <br /> zoning,. i <br /> The Chairman recognized Attorney Kilroy, who identified �. <br /> himself for the Record as Bernard Kilroy, representing the <br /> Applicant along with Richard Baxter., <br /> Attorney Kilroy made references to the legal case that had <br /> been cited in this matter, He stated Applicant is attempting to <br /> divide the land into two sections# the commercial/industrial <br /> parcel to be conveyed to one party and the residential, to be <br /> conveyed to another party, at which point they would be free to <br /> do as they chose with the property. He stated Applicant is not <br /> interested in developing the land, but to divide and sell it, <br /> Making references to a Plan entitled, "Plan of Land in <br /> Mashpee, MA, for John A. Drew, Heirs of Elise Otis, Heirs of <br /> Marion Hinckley" , Attorney Kilroy stated he feels there is <br /> R <br /> adequate frontage to provide for any vehicle/public safety <br /> concerns, Attorney Kilroy also stated Applicant would not be <br /> adverse to the inclusion of an endorsement noting some of the <br /> lots do not meet current zoning and would therefor not be ,,, <br /> buildable in their current configuration <br /> The Chairman questioned whether or not there is adequate ' <br /> frontage, and could not make that determination without the <br /> benefit of a plan showing the use of the site in question, as <br /> well as the adjoining sites and line of sight. The Chairman �+ <br /> again expressed his uncertainty witb regard to varying zoning. . <br /> L <br /> After brief discussion, Boar M ' �#, k'� <br /> d embers determ�.ried tit-: <br /> frontage deficiency to be "slightly more than half" , The <br /> w <br /> Chairman asked how granting the proposed waiver would benefit the ti <br /> Town, to which Attorney Kilroy replied it would allow for the <br /> division of the property, recording of the Deed, and would allow tag <br /> the new owner to deal with use requirements. � <br /> The Town Planner stated the proposed buyer in this matter is Mr. Talanian, and that a portion of the property is to be used as ` <br /> open space under the Cape Cod Commission requirements (2 1/2 <br /> acres) , with a road access from Route 28, which could create <br /> frontage for future lots. He also stated the theoretical- future <br /> use of this property is for a parallel road to Route 28.
