Having the town take the road involves politics, <br /> petitioning the town to take them, he is not sure it can be done. <br /> Would it make a difference if he could prove that is a county road? <br /> Tony responded if that road is improved to the road standards. <br /> Attorney Dranetz asked if there was any role the ZBA could play? <br /> Tony said no, this is subdivision control law. The only relief may be <br /> through the subdivision appeals board. Tom read the description for that <br /> board , it does not say any thing specifically about their ability to <br /> release covenants. <br /> Tony explained he does not know what else the board can do this evening . <br /> The Board has not been convinced that we have a basis to release the <br /> covenant. It may be that is was just a bad business deal for the owners. <br /> DISCUSSION <br /> Applicant: Peter Sullivan & George Morton <br /> Location : Route 28 (Quashnet Woods site) <br /> Request: Discussion of C-3 zoning article for May Town Meeting . <br /> Peter Sullivan and George Morton were present. <br /> Mr. Sullivan explained last time they were before the Board they thought <br /> 1 the re-zoning article would be on the town meeting warrant. Then at <br /> another meeting they were not present at, the Board decided this should be <br /> a petition by owner article. Tom called the applicant and told them. For <br /> some reason, the letter drafted by Berkshire Development - the owners - did <br /> not reach the Selectmen so the only evidence the Selectmen had at their <br /> meeting was that the Planning Board was withdrawing their support of the <br /> article. After calling Bob Whritenour, they found out that the Selectmen <br /> voted to not allow this article on the May 3 town meeting warrant. <br /> They recently met with the Chamber of Commerce who gave this project a vote <br /> •1,�4J of confidence. <br /> They are asking the Planing Board tonight to please re-sponsor the article <br /> _ so it an be on the warrant. <br /> Tony explained the Board decided to withdraw their support of the article <br /> providing it could be submitted as a petition article. The reason the Board <br /> went along with this in the first place was they were under the impression <br /> it had to be to the Board of Selectmen by the following Monday night or it <br /> would not get put on the warrant. That following Monday night, the <br /> Selectmen never discussed the article. <br /> Tom explained the following Monday was the published deadline for articles, <br /> it had to be submitted then to get on the warrant. <br /> Tony explained , after further discussion, the Planning Board decided it <br /> does not want to become involved with this at this stage. The people who <br /> will benefit from it should make and sell their case at town meeting . <br /> There are a lot of other issues involved that will effect this community <br /> for some time to come. This should not be rushed . This bylaw change is very <br /> complicated and is a major issue for this community . You told us Leisure <br /> Services and other town agencies are in support of this , yet we haven 't <br /> heard from any of them. We want to see all of the other agencies effected I <br /> 8 <br /> 4i'.uJf <br />
