Town of Mashpee <br /> y 1 <br /> 16 Great Xeck 1 oad J%rth <br /> Mosl ipee,Massaelmsett3 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A FINDING OF FACT <br /> SP-10-30 <br /> Mashpee Baptist Church Assessor's Map 36 Parcel 6 <br /> 27 Great Neck Road North Book: 240 Page: 179 <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 22, 2010 by the Mashpee Baptist Church for <br /> a Finding of Fact under Section 174-17 of the Zoning By-laws for permission to <br /> construct an addition to a pre-existing, non-conforming structure on property <br /> located in an R-5 zoning district at 27 Great Neck Road North (Map 36 Parcel 6) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on July 9, <br /> and July 16, 2010, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> July 28, 2010. The following members of the Board were present and acting <br /> throughout: Board Members Robert G.Nelson, William A. Blaisdell, John M. <br /> Dorsey and James Reiffarth, and Associate Board Member Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provisions of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Paul Ferazzi, contractor for the project, and Attorney Steven Tessier <br /> represented the Petition. Pastor Curtis Frye, Jr. and Mr. Robert McManus were <br /> also in attendance. <br /> Plans call for construction of a 23 x 30-foot addition to accommodate <br /> more seating. The Board of Health has already approved plans for a sewage <br /> system upgrade on the subject property. Attorney Tessier said that the pre- <br /> existing non-conforming structure does not conform to current zoning regarding <br /> use and setbacks. Mr. Nelson remarked that the proposed addition is more than <br /> five feet further away from the street than the existing structure. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> that the subject property is located at 27 Great Neck Road North and <br /> consists of 20,017 square feet of land. <br />
