The document does not authorize building <br /> 1 d g` <br /> on any of <br /> until all roadwork has been completed. <br /> The Vice Chairman inquired if the issue of ' <br /> utility poles is k <br /> clarified; Attorney Fitch answered they are located on the °E <br /> other side of the road, and that he has been instructed to k <br /> investigate the situation. ; <br /> (Consulting Engineer, Charles Rowley, arrived at the Meeting <br /> at this point, 7 : o o p.m. ) <br /> Attorney Fitch pointed out that both documents are cross- <br /> referenced. At this point, reference was being made to the <br /> Plan (easement, access, egress) . <br /> Both Thomas Fudala and Charles Rowley questioned whether or ; <br /> not the new developer would be obligated, under the Statute, to <br /> file a signed Covenant . <br /> r <br /> Attorney Fitch stated his request that the Board vote to <br /> authorize the signature of said document. The terms of the <br /> Covenant are not being modi f ied, request is for a partial release ; <br /> in a sense, without authorizingbuildabilit . <br /> y <br /> E�! <br /> There was discussion regarding language under the statute <br /> dealing with Covenants . <br /> Charles Rowley maintained that because frontage of the t' All <br /> entire parcel conforms and is located on Pimlico Pond Road, it kk <br /> could conceivably be released as a single piece. <br /> Attorney Fitch stated his reason for the request is based <br /> upon language of both the Statute and the Covenant, without , <br /> approval this sale could not be accomplished.
