Attorney Butler represented to the Board that , <br /> litigation has been settled and it is anticipated that all *+ , <br /> transactions and documents should occur within the next week to <br /> ten (10) days. <br /> • E <br /> Attorney Butler made reference to Preliminary and Updated <br /> Plans as presented to the Board. by Mr. Eldredge relating to units <br /> within Phase IB. The Board requested he address the issue of <br /> driveways/garages with reference to Building #30, back-up areas <br /> for the garages with reference to Buildings #29, #32, #37, and ; <br /> #39, and a back-up area for the parking lot of Building #32 . (At <br /> this point reference was being made to Phased Site Plan- <br /> Windchime Point-dated October 1, 1997011 <br /> Making reference to Mr. Eldredge' s letter, Attorney Butler <br /> stated it was understood the retaining walls are to be engineered <br /> structures and that safety rails are to be installed. Attorney <br /> Butler then made reference to Phases as related to total square <br /> footage. He explained the intent, under the terms and conditions <br /> of the Modif ication, is f or the Applicant to appear bef ore the <br /> Board for the purpose of requesting a modification of buildings <br /> within each phase. Buildings #30, #35, #36, and #37 are not Oki <br /> allowed to be modified. The purpose for this procedure would <br /> allow the Planning Board to give comment and render approval of <br /> each phase. A Certificate of Compliance is required upon ' <br /> completion of each phase. <br /> Attorney Butler stated that Mr. Bornstein may seek to <br /> increase the square footage of the total footprint of the <br /> buildings in this phase, with the understanding that the total <br /> square footage of coverage for the entire property, upon <br /> completion, cannot exceed the total amount approved in 1987. The <br /> only changes made were to two (2) narrow buildings that have been <br /> increased in terms of their size. + ;: <br /> } <br /> Attorney Butler requested of the Board conceptual approval <br /> of changes requested to Mr. Eldredge' s presentation ,and the final ,�I <br /> location of the buildings.
