41 <br /> Said area has been carried, over as a park •on all subsequent Town a <br /> records to date. The land was purchased in 1985 and the <br /> intention continued to be a park area as no request for Release <br /> was made at that point. <br /> .r <br /> Mr. Larson clarified the original request for a park area <br /> had not been made from the Planning Board, but rather from the <br /> developer. He further stated there is no Covenant on record; <br /> the Deed does not indicate a recreational 'area; and the Town has <br /> continued to tax said property as a buildable lot since 1968 . , <br /> He further stated the three (3) year time limit has expired; ` <br /> there is no indication that anyone has claimed rights to said <br /> property on any of the Deed copies; said property had been <br /> offered to the Town at one point and was not accepted. <br /> In response to a question regarding the condition of road s: <br /> frontage asked by the Chairman, Mr. Larson answered, "too feet. <br /> The Town Planner reiterated, the preliminary plan submitted # <br /> to the Planning Board, indicates the area in question to be four ` <br /> (4) Lots; which the Planning Board required to be set aside as a <br /> parr. The Statue allows the Planning Board to determine a park <br /> area, with a set three (3) year time limitation. <br /> The Chairman determined the area has not been developed, ,,, {; <br /> although it has been de-treed., as clarified by Mr. Larson. <br /> The Town Planner stated the original Request for Release of .4 <br /> Lots did not include the designated park area, as there was no <br /> intent to build upon it. The three (3) year limitation has . <br /> expired. This issue has come to light as a result of foreclosure ��` <br /> by the Town for back taxes. <br /> This matter was continued in order to allow Mr. Larson the ' <br /> opportunity a to fill out the required Request for Release form ` <br /> 7 . 15 p.m. ) . <br /> The Chairman determined at this point there was no one in ; <br /> attendance to represent The Bornstein Company Discussion <br /> scheduled for 6 :4 5 p.m. <br /> ii4 <br /> Release of Covenant <br /> Lipnoski Family Trust-Preakne s s Lane-Three Ponds Subdivision f <br /> The Chairman recognized Mr. Ed Govoni, who stated for the a <br /> Record, to be a representative of Mr. Lipnoski as developer of { <br /> the property. <br /> Mr. Govoni stated that Mr. Lipnoski has purchased the <br /> Property, Phase I and I I, for a total of seventeen (17) Lots. <br /> Mr. Govoni requested a Covenant Release.
