Town of Mashpee <br /> Planning Board <br /> Minutes of Meeting ` <br /> December 17, 1997 s y <br /> i <br /> i <br /> The Town of Mashpee Planning Board Meeting was called to <br /> order in Conference Room #1, Mashpee Town Hall, 16 Great Neck <br /> Road North, Mashpee, Massachusetts at 6: 35 p.m. on Wednesday, ' <br /> December 17, 1997 . The Chairman, Patrick Coffey, presided. <br /> Planning Board Members present-• Patrick Coffey, Chairman, <br /> Dennis Balzarini, vice Chairman; Chance Reichel; and John <br /> Kuchinski, Clerk (6:4 3 p.m. ) . <br /> Also present: Thomas Fudala, Town Planner; Eric Smith, <br /> Assistant Town Planner; and Charles Rowley, Consulting Engineer <br /> f <br /> 7 : 10 p.m. ) . <br /> Approval of Minutes .: <br /> The Chairman declared a quorum to be present and called the sr; <br /> Meeting to order. As the first order of business he addressed <br /> the matter of Minutes and entertained a motion for approval of <br /> the November 5, 1997 and December 3, 1997 Minutes. <br /> MOTION: Dennis Balzarini made a Motion to approved the E <br /> Minutes of November 5, 1997 and December 3, 1997, as written; <br /> which Motion was duly seconded by Chance Reichel and so voted <br /> unanimously. } <br /> Release of Covenant <br /> r <br /> David Hendrick/Kevin Andrade-old Barnstable Road <br /> The Chairman recognized David Hendrick, who requested the <br /> release of Lots 1, 2, and 3, as shown on a Plan entitled, <br /> Subdivision Plan of Land for Kevin Andrade in Mashpee, MA; , <br /> dated July 23, 1986 . Mr. Hendrick made reference to required <br /> of utilities with regard to said lots.frontage and constructiong -. <br /> Mr. Fudala recalled the Planning Board had denied request <br /> for release at one point (1986) , but had failed to file the <br /> Decision within the time frame required by Statute. Eventually <br /> the Town Clerk signed and recorded the Plan. He stated this to <br /> have been a matter of dispute for some time. one Condition of <br /> the Plan is that there is to be no access to old Barnstable Road. <br /> from said lots. <br /> References were made to letters by the Building Inspector <br /> and Anthony Ferragamo, Chairman of the Planning Board at the <br /> jr <br /> time. <br /> Mr. Fudala raised questions regarding grandfather issues <br /> and constructive approval . <br /> 1 <br />
