Mashpee Zoning <br /> Board of Appeal Willowbend Country Club <br /> 19 Simons Road <br /> 4 V-09-07 <br /> Attorney McElhinney explains to the Board that everything Willowbend has built thus far <br /> has complied with zoning since the 1985 special permit was granted. Willowbend could <br /> build far more units and it would not be as attractive as they are proposing. The taxes <br /> produced to the town from Willowbend are over $250,000 annually. <br /> Norma Lyons—33 Cranberry Ridge Road: she believes that a hardship has not been <br /> brought forth at all. <br /> Mr. Nelson mentions that having the Fire Chief sign off on this matter was vitally <br /> important to his decision process. He asks Mr. McElhinny should the board grant this <br /> relief that they make every effort to reduce the height where ever they can shave some <br /> space off. Mr. McElhinney and Mr. Mattson agree that they will make every effort to <br /> accommodate that request. <br /> After further discussion and review of the plans, Robert Nelson makes a motion to grant a <br /> 4 foot height variance for the condominium complexes proposed at 19 Simons Road. <br /> John Dorsey seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 19 Simons Road and contains 17,069 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br />
