The taxes <br /> produced to the town from Willowbend are over $250,000 annually. <br /> Norma Lyons—33 Cranberry Ridize Road: she believes that a hardship has not been <br /> brought forth at all. <br /> Mr. Nelson mentions that having the Fire Chief sign off on this matter was vitally <br /> important to his decision process. He asks Mr. McElhinny should the board grant this <br /> relief that they make every effort to reduce the height where ever they can shave some <br /> space off. Mr. McElhinney and Mr. Mattson agree that they will make every effort to <br /> accommodate that request. <br /> After further discussion and review of the plans, Robert Nelson makes a motion to <br /> grant a 4 foot height variance for the condominium complexes proposed at 25 Simons <br /> Road. John Dorsey seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 25 Simons Road and contains 16,050 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on March 25, 2009 <br /> to grant a 4 foot height variance. This is conditioned on plans from Baxter Nye <br /> Engineering & Surveying of Hyannis, MA, dated February 25, 2008. <br />
