Mashpee Zoning <br /> Board of Appeals John and Ann Kelleher <br /> 2 V-08-50 <br /> Russell Wheatley represented the applicants Mr. and Mrs. <br /> Kelleher who are also present. They would like to build a deck <br /> (12' x 39') and are seeking a variance to the wetlands. They have <br /> been through conservation and the determination was granted in <br /> their favor. Mr. Wheatley shows the board marked up copies of <br /> the plans he submitted to the Conservation Commission. Lori <br /> Corsi asks if these are the same plans that Conservation has <br /> approved. There was some discussion as to the understanding of <br /> what Mr. Wheatley presented to the Board. He customized the <br /> plans for certain requirement of the ZBA, however, by marking <br /> them up he has made them different from what Conservation has <br /> approved. The plans should be dated December 15, 2008 and <br /> revised on January 14, 2009. Mr. Nelson asks the Kellehers to <br /> bring in the plans with the proper date of 2009 on them. They <br /> agree to have this done. The Board determines that the substance <br /> of the plan remains the same. The Board reviews the plans and <br /> since the Conservation Commission has granted the project to be <br /> appropriate they find no problem with the granting of this variance. <br /> James Reiffarth makes a motion to grant a 34 foot variance to the <br /> wetlands. <br /> GENERAL FINDINGS <br /> 1. the property is located at 4 Point Road and contains 23,650 <br /> square feet. <br />
