]own of Mashpce <br /> [ y I6 (1 -cat N�eck Toad <br /> MASHPEE ZONING BOARD OF APPEA <br /> laslpee,lVassachusats 02649 <br /> Decision for a Special Permit <br /> "Findings of Fact" <br /> RE: Stephen Marcus 52 Spoondrift Way <br /> & Carol Augustyniak Map 112 Parcel 36 <br /> SP-08-49 <br /> A Petition was filed on November 6, 2008 for a Special Permit and Findings of <br /> Fact under Sections 174-17, 174-20 and 174-24C of the Zoning By-laws for permission <br /> to raze and replace a pre-existing, non-conforming dwelling and rebuild a new dwelling <br /> on property located in an R-3 zoning district at 52 Spoondrift Way (Map 112 Parcel 36) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 14, 2008 and <br /> November 21, 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled to be heard on Wednesday, December 10, 2008 <br /> but continued several times and was heard on Wednesday, February 11, 2009 on the <br /> Petition at the Mashpee Town Hall, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, <br /> James Reiffarth, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> This matter was originally scheduled for December 10, 2008 and has been <br /> continued until tonight due to several issues in conservation and for general scheduling <br /> matters. The matter is still pending in Conservation. <br />
