This property is located in an R-3 zoning district at 38 Pleasant <br /> Park (Map 70 Parcel 165) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 14, 2008 and <br /> November 21, 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 10, 2008, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, <br /> James Reiffarth, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Quinn's variance has expired without substantial commencement of <br /> construction. He has applied again for the same variance consisting of a landspace <br /> variance of 17,500 square feet and 25 feet of frontage. <br /> Thomas Quiml is the owner of both aforementioned lots. James Griffiths is <br /> representing Mr.Quimi as he is out of town. They were previously granted variances for <br /> landspace and for frontage requirements. Due to the economy, the lots have not been <br /> sold and therefore no substantial commencement of construction has begun so the <br /> variances expired. He is seeking the same variance requests are before; both need 17,500 <br /> square feet and 25 feet of frontage. The Board reviews the plans and finds that nothing <br /> has changed on the requests. Robert Nelson moves to grant a 17,500 square foot <br /> landspace variance and a 25 foot frontage variance. <br /> GENERAL FINDINGS <br />
