This property is located in an R-3 zoning district at 30 Pleasant Park (Map
70 Parcel 166) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on November 14, 2008 and
November 21, 2008, a copy of which is attached'hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, December 10, 2008, at which time the following members of the Zoning
Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush,
James Reiffarth, William Blaisdell and Jack Dorsey.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Thomas Quiml is the owner of the aforementioned lot. James Griffiths is
representing Mr.Quim1 as he is out of town. They were previously granted variances for
landspace and for frontage requirements. Due to the economy, the lots have not been
sold and therefore no substantial commencement of construction has begun so the
variances expired. He is seeking the same variance requests are before; both need 17,500
square feet and 25 feet of frontage. The Board reviews the plans and finds that nothing
has changed on the requests. Robert Nelson moves to grant a 17,500 square foot
landspace variance and a 25 foot frontage variance.
