Paulding, Trustee 64 Industrial Drive <br /> Makedo Realty Trust Map 88 Parcel 34 <br /> V-07-20 <br /> A Petition was filed on January 5, 2007 for a Variance from Section 174-31of the <br /> Zoning By-laws for permission to vary the rear setback requirements in order to build a <br /> 20,000 square foot commercial building on property located in an I-1 zoning district at 64 <br /> Industrial Drive (Map 88 Parcel 34) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 12, 2007 and <br /> January 19, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 24, 2007 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Marshall Brem and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicant at this <br /> hearing. Applicant is proposing to build a 20,000 square foot commercial building <br /> (originally 20,870 square feet). Although the building was reduced in size they are still <br /> unable to maintain the 50 foot rear setback requirements. Abutter Kevin Kayer is present <br /> and is in support of the project. Mr. Kelliher, who also built Mr. Kayer's building <br /> proposes to build a similar building. The lot is a corner lot and does constitute a hardship <br /> for applicant. Frederick Borgeson moves to grant a 20 foot variance to the rear. <br />
