f,'it3t6'ry - e MASHPEE ZONING BOARD OF APPEALS 16 Grcat Nick Aoacl JV�)t-th, ��v�nuikc fey MaSlipec, Massachusetts 0 649 Decision for a Special Permit RE: 260 Heath Street Realty Trust 16 Popponesset Island Road Map 105 Parcel 265 SP-07-38 A Petition was filed on June 11, 2007 for a Special Permit under Section 174- 25(I)(9) of the Zoning By-laws to build a pier, ramp and float on property located in an R-3 zoning district at 16 Popponesset Island Road (Map 105 Parcel 265) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 15, 2007 and June 22, 2007 a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, June 27, 2007, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert G. Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and James Reiffarth. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. Michael McGrath of Holmes and McGrath represents the applicant at this hearing. They are seeking a special permit in order to build a pier, ramp and float and a variance to exceed the 70 foot maximum allowable limit for the length. Mr. McGrath informs the Board that all criteria have been met for obtaining a special permit. The Shellfish Warden has approved the matter. There will be installation of a rip rap wall. The variance requested is 69 feet. The Board reviews the plans and find the request to be acceptable for the installation of a pier, ramp and float. Marshall Bern moves to grant a Special Permit
