Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 30, 2005 and <br /> January 6, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was.held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 11, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Marshall Brem and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinksy of Cape & Islands Engineering, represents the applicant at this <br /> hearing. They are seeking a special permit in order to demolish the existing dwelling and <br /> a variance for the setback relief, landspace requirements and frontage requirements. This <br /> is the same set of plans and requests that was previously granted to this property, only it <br /> has expired. The Board of Health is still in the process of granting a variance to the well <br /> —there should be no problem with that. There is a discussion of striking section 174-21 <br /> from the application request since it is from some old by-laws and no longer necessary. <br /> There is a letter from an abutter, Bob Luckraft of 33 Riverside Road who discusses how <br /> narrow the streets are and how he wants adequate off street parking made available. <br />
