Mashpee Zoning David DiSciullo 2 <br /> Board of Appeals SP-06-03 <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed construction does not conform to the setback requirements <br /> and the Board has granted a Variance. <br /> 2. that the proposal would not be substantially more detrimental than the existing <br /> structure. <br /> 3. that the proposal would enhance the lot. <br /> 4. that the installation of a new septic system would be an improvement to the <br /> lot. <br /> 5. that construction of a new home would be an improvement to the <br /> neighborhood. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that <br /> the applicant met the criteria necessary for the granting of a Special Permit. Upon <br /> motion duly made and seconded,the Zoning Board of Appeals voted unanimously on <br /> January 11, 2006 to grant a Special Permit to demolish the existing structures and <br /> construct a single-family home on the subject property. The Special Permit is <br /> conditioned upon compliance with plans from Cape &Islands Engineering, dated <br /> September 26, 2002, plan no. 092602.. <br />
