This property is located in an R-5 zoning district at 52 Lowell <br /> Road (Map 52 Parcel 36) Mashpee, ARIA, <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 22, 2003 and <br /> August 29, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wechlesday, January 11. 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Evano Cunha and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Medeiros represents himself at this hearing. IIe was previously granted a <br /> variance iii order to make this lot buildable but it expired before he Nvas able to build on <br /> it. He is again before the board with the same request. He is seeking a 68,047 square <br /> foot landspace variance in order to make this lot buildable. The Board reviews the <br /> paperwork and since everything is in order regarding the assessed value and taxes paid, <br /> Frederick Borgeson makes a motion to grant a 68,047 square foot landspace variance. <br /> Marshall Brem seconds the motion. All agree. A roll vote is taken. Fred Borgeson votes <br /> yes. Marshall Bern votes yes. Zella Elizenberry votes yes. Evano Cunha votes yes. <br />
