Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 30, 2005 and <br /> January 6, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 11, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Marshall Brem and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Donald Cook represents himself at this hearing. The board reviews the Plans and <br /> finds he is trying to build a garage and cannot meet the setback requirements. They <br /> discuss the number of vehicles in the driveway and yard. Mr. Cook says that he owns <br /> several along with his children. There is a corner lot issues which presents an additional <br /> burden to the applicant whereby he must maintain two frontage setbacks. Fred Bergeson <br /> makes a motion to grant a 2.9 foot variance from Quinaquisett Avenue. Robert Nelson <br /> seconds the motion. A roll vote is taken. Fred Borgeson votes yes. Robert Nelson votes <br /> yes. Zella Elizenberry votes yes. Marshall Brem votes yes. Evano Cunha votes yes. All <br /> agree. So moved. <br />
