Town of Maslipee <br /> 16 Great Seck koa(1,Xi)Nh <br /> Nlash,pec, AKissochusctts 0264 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> Re: Celine Surrette 204 Ashers Path W . <br /> Map 52 Parcel 38 <br /> SP-06-19 <br /> A Petition was filed on February 8, 2006 for a Special Permit under Section 174- <br /> 45.4 of the Zoning By-laws to turn the existing basement into an accessory apartment on <br /> property located in an R-5 zoning district at 204 Ashers Path W (Map 52 Parcel 38) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, March 3, 2006 and March 10, <br /> 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Healing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 22, 2006 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Celine Surrette represents herself at this hearing. She is seeking a Special Permit <br /> in order to turn her existing basement into an apartment for herself. The Board reviews <br /> the plans and dicusses the site visit. They discuss the need to have a bulkhead, window <br /> and front door installed. Applicant agrees to do this. The By-law is discussed as to <br /> whether or not the homeowner needs to live in the larger part of the home or the <br /> accessory apartment. Her family is living upstairs and they need the extra space for <br /> children. The Board agrees that the by-law does not specify what part of the house the <br /> applicant must live in. The Board of Health has signed off on this as well. The Board <br /> moves to grant the Special Permit. <br />
