Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on March 3, 2006 and March <br /> 10, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 22, 2006 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, <br /> Zella Elizenberry, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Christine Fairneny represents her mother Frances Fairneny at this hearing along with <br /> Stephen Doyle of Stephen Doyle and Associates. Mr. Doyle explains to the Board that <br /> the lot line that he originally layed out was not correct. The Board granted the applicant a <br /> variance of 6.7 feet from the southerly side. The foundation was poured and it was <br /> realized that the lot line was incorrect. The applicant is now seeking 12.6 foot variance in <br /> order to accommodate the original garage plans. The direct abutter, Joanne Winter of 64 <br /> Clover Lane, is in full support of this adjusted variance. The Board reviews the plans and <br /> sees that it was a mistake by the engineer. Since nothing has changed with the building <br /> of the garage and the neighbor has no problem with it, the Board moves to grant a 12.6 <br />
