Town of Mashwe <br /> 16 Great Neck &oad_c)rth <br /> MASHPEE ZONING BOARD OF APPEAL�Iashpee,_1�Ictssachu.setts 02049 <br /> i `��1UdE Lam" <br /> Decision for a Variance <br /> RE: David Edlin 5 Bowsprit Point <br /> Map 105 Block 230 <br /> V-06-31 <br /> A Petition was filed on March 22, 2006 for a Variance from Sections 174-31 and <br /> 174-33 of the Zoning By-laws to seek relief from the setback requirements and distance <br /> to wetlands in order to build a new dwelling on property located in an R-3 zoning district <br /> at 5 Bowsprit Point (Map 105 Block 230) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on April 7, 2006 and April <br /> 14, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, <br /> Marshall Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Anthony Ferragamo represents the applicant at this hearing. They are seeking <br /> several variances in order to rebuild a dwelling. They are demolishing the existing <br /> dwelling and will need a landspace variance due to the size of the lot once the lot become <br /> vacant again. In addition to setback relief they are also seeking a variance to the <br /> wetlands. The Concervation Commission has approved these plans. The Board reminds <br /> Mr. Ferragamo that they will not allow any more than 20% lot coverage and will require <br /> the plans to be reduced to show 20%. Mr. Ferragamo will replace the plans with the new <br /> ones showing the change. There will be 35 feet to the wetlands and the Board moves to <br /> grant the following variances: <br /> ✓ A 14.5 foot sideyard variance <br />
